These Terms of Service ("Terms") govern the use of QORO10.COM and purchases made through our online store.

Throughout these Terms, "QORO10", "we", "us" and "our" refer to SPORTS HEROES S.L.

Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and services to you.

By placing an order through our website, you agree to these Terms. Nothing in these Terms limits or excludes any mandatory rights you have under applicable consumer protection law.

1. Products

We make reasonable efforts to display and describe our products accurately, including their colours, designs, dimensions and other characteristics.

However, the appearance of colours and other visual characteristics may vary depending on your device, screen settings and other technical factors.

Product images may include lifestyle or illustrative photography. Minor visual differences that do not affect the essential characteristics of the product may occur.

We reserve the right to modify or discontinue products and to limit product availability, provided that this does not affect orders already accepted by us.

2. Orders and Formation of the Contract

By submitting an order, you make an offer to purchase the products in your order.

After placing your order, you will receive an electronic confirmation acknowledging receipt of your order.

The sales contract is concluded when we confirm acceptance of your order.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including product unavailability, an obvious pricing or product information error, suspected fraud, payment problems, or restrictions affecting our ability to fulfil the order.

If we cancel an order after payment has been received, we will refund the corresponding amount without undue delay.

Please review your order carefully before submitting it.

3. Prices and Payment

Prices displayed on our website are shown in the currency applicable to the relevant market.

Where required by applicable law, prices displayed to consumers include applicable taxes.

Any applicable shipping charges will be displayed before you complete your purchase.

For deliveries to destinations where customs duties, import taxes or other charges may apply, additional charges may be payable by the recipient unless expressly stated otherwise during checkout.

Payment must be made using one of the payment methods available at checkout.

We reserve the right to correct obvious pricing errors. If an obvious pricing error affects an order you have already placed, we will contact you and, where appropriate, give you the option to confirm the order at the correct price or cancel it for a full refund.

4. Shipping and Delivery

We will deliver your order to the delivery address provided during checkout.

Any delivery dates or timeframes shown on our website are estimates unless expressly stated otherwise.

We will deliver goods without undue delay and within the period required by applicable consumer law.

Unless another delivery period has been agreed with you, goods will be delivered no later than 30 calendar days after conclusion of the contract.

If we are unable to deliver within the agreed or legally applicable period, you will have the rights provided by applicable consumer protection law.

The risk of loss or damage to the goods passes to you when you, or a third party designated by you other than the carrier, takes physical possession of the goods.

If you independently appoint a carrier that was not offered by us, the risk may pass to you when the goods are delivered to that carrier, as provided by applicable law.

5. Right of Withdrawal and Returns

Consumers may have a statutory right to withdraw from an online purchase.

For consumers in the European Union, this generally includes the right to withdraw from eligible purchases within 14 calendar days after receiving the goods, without giving a reason, subject to the exceptions established by law.

Nothing in these Terms or our Return & Refund Policy limits any mandatory consumer rights provided by applicable law.

6. Conformity and Legal Guarantee

Products sold through QORO10 are covered by the statutory conformity guarantees applicable under consumer protection law.

If a product is defective, damaged, incorrect or otherwise does not conform to the contract, you may be entitled to the remedies provided by applicable law.

These statutory rights are separate from the right of withdrawal and are not limited by our Return & Refund Policy.

7. Intellectual Property

The content of QORO10.COM, including our original designs, graphics, photographs, videos, text, logos, branding, website content and other materials, is protected by applicable intellectual property laws.

Unless otherwise stated, such content is owned by or licensed to SPORTS HEROES S.L.

You may access and use the website for personal and non-commercial purposes.

You may not reproduce, distribute, modify, commercially exploit or otherwise use protected content from our website without our prior written permission, except where permitted by applicable law.

Third-party trademarks, names or other intellectual property appearing on the website remain the property of their respective owners.

Our store is powered by Shopify.

Shopify provides the ecommerce technology that enables us to operate the online store, but purchases made through QORO10 are made from SPORTS HEROES S.L., not from Shopify.

Our website may also contain links to or integrations with third-party services.

Those third-party services may be subject to their own terms and privacy policies.

Personal information is processed in accordance with our Privacy Policy and applicable data protection law.

To the extent permitted by applicable law, we are not responsible for losses that were not reasonably foreseeable when the contract was concluded or that result from circumstances outside our reasonable control.

12. Events Outside Our Reasonable Control

We are not responsible for delays or failure to perform our obligations where caused by circumstances outside our reasonable control.

Where such circumstances affect the delivery of an order, we will take reasonable steps to inform you and minimise the impact.

Your mandatory rights under applicable consumer law remain unaffected.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, business practices or applicable law.

The version applicable to your purchase will generally be the version in effect when you place your order.

Any changes will not retroactively reduce rights arising from orders already concluded.

14. Governing Law and Consumer Rights

These Terms are governed by Spanish law, without prejudice to any mandatory consumer protection rights that may apply to you under the laws of your country of habitual residence.

If you are a consumer residing in another country, nothing in these Terms deprives you of mandatory protections that apply to you under applicable law.

Any dispute will be subject to the jurisdiction determined by applicable law. Nothing in these Terms requires a consumer to bring proceedings exclusively before courts in Spain where applicable consumer law provides otherwise.

15. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will apply to the maximum extent permitted by law or, where necessary, be severed without affecting the validity of the remaining provisions.
